- GENERAL
These General Terms and Conditions are drawn up in accordance with the applicable legislation of the Republic of Slovenia, the currently valid Consumer Protection Act (ZVPot-1), the Personal Data Protection Act (ZVOP-2), the recommendations of the Chamber of Commerce and Industry of Slovenia (GZS) and international e-commerce codes.
The General Terms and Conditions of the online store www.nikayajewelry.com (hereinafter: the online store) define the conditions of purchase and sale of products in the online store, which is operated by NIKAYA, oblikovanje nakita in trgovina d.o.o. (hereinafter: the provider).
The General Terms and Conditions are published in a visible place on the website and are permanently available there. The buyer is bound by the General Terms and Conditions that are in force at the time of purchase or order placement and which form an integral part of the sales contract. The provider reserves the right to change the General Terms and Conditions at any time and without prior notice. The amendments take effect on the day of their publication and are binding for users from that date onwards.

- PRODUCTS FOR SALE
In the online store, the provider offers jewelry made of gold of fineness 585/000 and 750/000, silver of fineness 912/000, or combinations of these materials. Silver products and white-gold products may be additionally protected with rhodium plating. The offer also includes jewelry with brilliant-cut diamonds or other precious stones.
For gold jewelry and jewelry with precious stones we provide a certificate of authenticity and quality.
All products are properly marked with the fineness of the metal, the maker’s mark and also carry the conformity mark for products (state hallmark of the Metrology Institute of the Republic of Slovenia).
- AVAILABILITY OF INFORMATION
The provider undertakes that the buyer will be provided, before being bound by a contract or offer, with at least the following information:
- details of the provider (name, registered office and registration number),
- contact details for quick and effective communication (telephone number, email),
- essential characteristics of the products in the offer,
- information on product availability,
- delivery conditions (method, place and time of delivery),
- prices, clearly defined, including an indication of whether they already include VAT, transport costs and any other charges,
- methods of payment and delivery,
- the period of validity of the offer,
- the period during which it is possible to withdraw from the contract and the conditions for withdrawal,
- an explanation of the complaints procedure, including all data on the contact person.
- ORDERING PRODUCTS OR SERVICES
Products can be ordered in the online store 24 hours a day, every day of the year. Services are provided within the territory of the Republic of Slovenia, and delivery is also possible to EU Member States. An order may be placed by a natural or legal person. If the buyer is a legal entity, additional fields for the identification of the legal entity must be completed. Ordering is carried out in the Slovenian language.
The provider will store the order or sales contract on the server and will, at the buyer’s request sent by email to sales@nikayajewelry.com, forward it to the buyer.
- ORDER PLACEMENT PROCESS
In the online store, the buyer selects a product or products and adds them to the cart, reviews the cart, enters billing and delivery details, selects the delivery and payment method, and confirms the order.
The buyer adds (or removes) products to the cart using the “ADD TO CART” button. By clicking the “VIEW CART” button, the buyer can view the products in the cart and the total value of the order (excluding delivery costs and any other costs related to the payment method). In the cart, the buyer can change the quantity of products, if stock allows, using the plus/minus buttons and clicking “UPDATE CART”. At this stage, the buyer may also remove products they do not wish to purchase.
In the “COUPON CODE” field the buyer can enter a valid discount code and click “APPLY COUPON”.
By clicking “PROCEED TO CHECKOUT”, the buyer moves to the next step. First, they enter billing information (name, surname, country, street, postal code, city, telephone number and email address). When ordering via the online form, in addition to personal data (name and surname, address, email), a telephone number is also required so that the provider or the delivery service can inform the buyer about the progress of the order (all such messages are free of charge for the buyer).
If the buyer wishes the products to be delivered to another address, they tick the field “Ship to a different address?” and additional fields for the new address (name, surname, country, street, postal code, city) open. After entering these details, the buyer selects the delivery method and payment method. Before submitting the order, the buyer must confirm that they have read and agree with the General Terms and Conditions.
The buyer then completes the purchase by clicking the “PLACE ORDER” / “BUY NOW” button. Throughout the ordering process and up to this final step, the buyer is able to review the order, identify and correct any errors.
The order becomes valid and binding once the buyer submits it (by pressing the “buy now” button in the cart). Immediately thereafter, the buyer receives an automatic email notification from the provider confirming that the order has been successfully submitted. This email is not confirmation that the product is in stock or that shipment has begun.
In the case of payment by credit card or cash on delivery, the order will be confirmed and dispatched as soon as possible, and at the latest within 6 weeks of submitting the order, with a new email confirming the order and its dispatch. In the case of payment by pro forma invoice, the buyer will receive confirmation of the order and dispatch immediately after the payment has been made. Once the full order amount is credited to the provider’s bank account, the order is considered paid. The buyer has 8 days to pay the pro forma invoice. If payment is not made within this period, the provider may cancel the order/contract. As a rule, the provider will dispatch the order on the same or the next business day after receipt of payment, and no later than within 5 business days of receiving the full purchase price.
If the ordered product is not in stock or the order cannot be fulfilled for other reasons, the buyer will be informed by telephone or email. In case of an error, the buyer may cancel the order without additional costs at any time up until receiving the email confirming the order and its dispatch.
By placing the order, the buyer confirms that they have been informed of the General Terms and Conditions and have been explicitly made aware of them. Registration is not required for a purchase in the online store. The data is stored in the customer database and the buyer may request access to their personal data. In any case, the buyer may request a copy of the sales contract via email at sales@nikayajewelry.com.
The sales contract between the provider and the buyer in the online store is concluded at the moment the provider sends the buyer the first email confirming the order. From this moment on, all prices and other conditions are fixed and apply equally to both the provider and the buyer.
- CHANGE OF ORDER
After placing an order, the buyer may cancel or change it by submitting a new order with updated data on the website and sending a cancellation request for the previous order to sales@nikayajewelry.com. The buyer may also cancel or change the order by telephone at 041 270 396.
- PRICES
All product prices listed on the website are in euros (EUR) and include 22% value added tax (VAT). Delivery/shipping costs are not included. The prices and discounts valid at the time the order is placed apply.
The validity periods of promotional prices are specified in the online store. Promotional prices and discounts valid at the time of purchase are automatically applied upon order submission and do not need to be claimed separately. If, for any reason, a promotional price or discount is not applied in the final calculation, the buyer must inform the provider in advance and request a correction of the invoice or rectification of the price error. If the buyer pays the amount shown in the final calculation without the discount or promotional price applied, it is considered that they accept the final price and cannot later raise a complaint. Notwithstanding this, the provider may, at their own discretion and depending on the circumstances, reimburse the price difference or issue a credit note for future purchases.
The listed prices apply only to purchases in the online store.
The price in the online store is the same for registered users and guests. We reserve the right to change prices without prior notice.
- GIFT VOUCHERS AND DISCOUNT CODES
In the online store it is possible to pay with gift vouchers. When purchasing an e-gift voucher, the buyer receives a unique code for the voucher value by email, which can be redeemed at checkout. The code is entered in the cart under “APPLY COUPON” or at checkout under “ENTER CODE”, and the voucher amount is automatically deducted from the total order value. A gift voucher can only be used in its full amount. If the order value exceeds the value of the voucher, the buyer pays the difference. If the order value is lower than the value of the voucher, the provider does not refund the remaining amount.
Gift vouchers can never be exchanged for cash.
The voucher may be transferred to another person, but only in its full value. When using a physical gift voucher, the buyer or holder must present the original voucher to the provider. Photocopies or any other forgeries of the voucher will not be accepted.
If the buyer has a discount code, they can use it at checkout. The buyer enters the code in the cart under “APPLY COUPON” or at checkout under “ENTER CODE” and the discount amount or percentage is automatically applied to the total value of the order or to an individual product, depending on the type of code.
If the buyer withdraws from the contract and used a discount code for the purchase, this discount is taken into account when refunding the payment. The buyer is only entitled to a refund of the amount actually paid for the product.
Discount codes are valid only for purchases through the website and must be entered in the cart under “APPLY COUPON” or at checkout under “ENTER CODE”.
- PAYMENT METHODS AND INVOICING
The online store offers several payment methods:
- Payment by credit card
Payment by credit card is processed via the Stripe payment system. Stripe is a very secure system that supports the 3D Secure 2 standard – a card authentication system introduced by the European Payment Services Directive (PSD2). - Payment by pro forma invoice
The buyer submits the order and receives an email containing the payment details. The payment deadline is 3 business days from receipt of the email.
The provider reserves the right, in cases where the buyer does not accept the parcel, to require prepayment for any subsequent orders before dispatch.
The provider sends the buyer an e-invoice or a printed invoice if the buyer explicitly requests it.
The invoice itemises the price and all costs related to the purchase.
Until the purchase price is paid in full, the selected products remain the property of the provider.
- DELIVERY
Delivery is handled by Pošta Slovenije or DHL Express. Delivery costs are charged in accordance with the current price list of the carrier, and the shipping cost depends on the size of the parcel. The cost is shown at checkout so that the buyer is informed in advance.
Within the Republic of Slovenia, delivery costs 4.80 EUR for purchases up to 150.00 EUR and for parcels up to 5 kg.
Delivery is free of charge within Slovenia for purchases over 150.00 EUR when using Pošta Slovenije.
For other EU Member States and other countries, delivery costs 25.00 EUR, regardless of parcel weight.
The buyer may also collect the order in person at the provider’s premises at Ježkova ulica 1, Ljubljana, once notified that the order is ready for collection. Collection is possible only during official opening hours or by prior arrangement.
The provider is not liable for delays caused by the carrier.
From the moment the provider hands over the parcel to the carrier, the provider does not accept responsibility for loss or damage to the shipment during delivery. The same applies to loss or damage during return of the product by a delivery service.
- WITHDRAWAL FROM THE CONTRACT AND RETURN OF GOODS
A buyer who is a consumer (natural person) has the right to withdraw from the contract within 14 days of receiving the product, without stating any reason. The buyer must notify the provider of the withdrawal by means of an unambiguous statement sent by email, clearly indicating that they are withdrawing from the contract. The withdrawal period starts on the day following receipt of the product.
In the event of withdrawal from the contract, the buyer must return the product to the provider no later than 14 days from sending the withdrawal notification. The buyer may return the product in person to the provider’s business premises by prior arrangement or send it by post to the address stated in point 2 of these General Terms and Conditions. The return deadline is considered met if the product is delivered to the provider’s address or posted by registered mail before the expiry of the 14-day period.
The buyer must return the product undamaged and in an unchanged quantity, unless the product has been destroyed, spoiled, lost or its quantity reduced without fault of the buyer. The buyer is liable for any diminished value of the product resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the product. From the moment of withdrawal, the buyer may not continue to use the products freely.
In the event of withdrawal, the provider will refund the purchase price as soon as possible and no later than 14 days after receiving the returned product. The refund will be made using the same payment method used for the original transaction, unless the buyer expressly requests otherwise. Cash refunds are not possible.
If the buyer used a discount, bonus or promotional code when purchasing the product, these are considered as a discount in the event of withdrawal and are not refunded. A gift voucher is considered as a means of payment and is refunded to the buyer in the form of a new gift voucher.
In the event of withdrawal from the contract, the buyer bears the cost of returning the product.
In accordance with point 2 of Article 135 of ZVPot-1, the buyer has no right to withdraw from the contract for goods made to the consumer’s specifications or clearly personalised.
Returns are not accepted in the following cases:
- when the buyer ordered a product based on their own design,
- products with a personal engraving,
- wedding rings.
- WARRANTY
All products in the online store are covered by a 12-month warranty from the date of purchase. The warranty can be claimed upon presentation of the invoice. Mechanical damage, improper use or use of products contrary to the manufacturer’s instructions voids the warranty.
- ASSERTION OF CLAIMS IN CASE OF NON-CONFORMITY OF GOODS
The provider supplies the buyer with goods that meet the requirements of Articles 72, 73 and 74 of ZVPot-1, where appropriate, and is liable for any non-conformity existing at the time of delivery. The provider is liable for any non-conformity that becomes apparent within two years of delivery.
The buyer has the right to exercise their rights arising from the non-conformity of goods in accordance with ZVPot-1 (detailed from Article 81 to Article 87).
The buyer may exercise their rights if they notify the provider of the non-conformity within two months from the day the non-conformity was discovered. The notification may be given in person (the provider issues a confirmation of receipt), sent to the store where the goods were purchased, or sent to the representative of the provider with whom the sales contract was concluded. In the notification, the buyer must clearly describe the non-conformity. The buyer may notify the provider in person, by telephone at +386 41 270 396, or by email at sales@nikayajewelry.com. The notification must be accompanied by the invoice or the order number. The buyer must allow the provider to inspect the goods for which the claim is made. If the existence of the non-conformity is disputed, the provider must submit a written reply to the buyer within 8 days.
The provider is not liable for any non-conformity that appears after two years from delivery of the goods.
The rights from the first paragraph of Article 81 of ZVPot-1 expire two years after the buyer notifies the provider of the non-conformity.
In the case of non-conformity, the buyer who has notified the provider is entitled, under the conditions and in the following order, to:
- request that the provider restore conformity of the goods free of charge;
- request a proportional reduction of the purchase price or withdraw from the sales contract and request a refund of the amount paid.
The buyer may request that the provider restore conformity within a reasonable time from notification, not exceeding 30 days. The provider may extend this period by up to 15 days, taking into account the nature and complexity of the goods, the severity of the non-conformity, etc. The provider must inform the buyer of any extension before the 30-day period expires.
The buyer may choose between repair of the goods and replacement with new goods, unless this is impossible or involves disproportionate costs compared to the other remedy, taking into account all circumstances.
Regardless of the above, the buyer may withdraw from the contract and immediately request a refund if the non-conformity appears within 30 days of delivery of the goods.
The assertion of rights arising from non-conformity is further regulated by ZVPot-1.
The buyer may not withdraw from the sales contract if the non-conformity is only minor. The burden of proof that the non-conformity is minor lies with the seller.
- LIMITATION OF LIABILITY
The provider makes every effort to ensure that the information published on the website is up-to-date and accurate. Nevertheless, product characteristics, prices or delivery times may change so quickly that the provider is unable to update the data immediately. In such cases, the provider will inform the buyer of the changes and allow them to withdraw from the contract or replace the ordered product.
Photographs do not guarantee product characteristics. The provider strives to present products with as accurate photographs as possible, but all images should be considered symbolic (differences in colour shades are possible).
- COLLECTION OF ITEMS
The buyer must collect the item ordered in the online store within 7 days of receiving the notification from the delivery service. Otherwise, the parcel is returned from the delivery service to the provider’s warehouse. Once the parcel is returned, the buyer can collect it at the provider’s address within 7 days. If the buyer does not collect the product within this additional 7-day period, the provider will cancel the order. If the buyer wishes the parcel to be re-sent after it has been returned, they must pay the additional shipping costs in advance.
- INTELLECTUAL PROPERTY
All content of the online store www.nikayajewelry.com (logo, photographs, texts, recordings, etc.) is protected by copyright. The provider and/or the person expressly indicated for a specific piece of content holds all economic copyright to the material published on this website.
- COMPLAINTS AND DISPUTES
The provider respects consumer protection legislation and strives to ensure an effective complaints-handling system. In case of problems, the buyer may contact the provider by telephone at +386 41 270 396 or by email at info@nikayajewelry.com.
The complaint-handling procedure is confidential.
The provider is aware that the essential characteristic of consumer disputes is the disproportion between the value of the product and the time and costs involved in resolving the dispute; therefore, the provider endeavours to resolve any disputes amicably.
The provider does not recognise any out-of-court consumer dispute resolution body as competent for resolving consumer disputes that may be initiated by the buyer under the Out-of-Court Settlement of Consumer Disputes Act.
The provider and the user will attempt to resolve disputes amicably. If this is not possible, the District Court in Ljubljana shall have jurisdiction to settle the dispute.
These General Terms and Conditions are valid from 1 October 2025.
